Welcome to ChefLink Sydney (cheflinksydney.com) (the "Platform", "Service", "we", "us", "our"), operated from Sydney, New South Wales, Australia. These Terms & Conditions ("Terms") govern your access to and use of the Platform, whether as a Chef creating a profile or as a Restaurant/Venue browsing chef profiles. By accessing the Platform, creating a profile, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

"Chef" means an individual who creates, submits or maintains a profile on the Platform. "Venue" or "Restaurant" means any business, individual or representative who browses, searches or contacts a Chef through the Platform. "Content" means any text, images, photographs, biographical information, dish descriptions, qualifications, restaurant history, contact details or other material submitted by a Chef. "Profile" means a Chef's public-facing page on the Platform displaying their Content. "Subscription" or "Plan" means a paid tier of access purchased by a Chef for enhanced Profile visibility or features.

2. About the Service

ChefLink Sydney is a profile-hosting and discovery platform that allows hospitality chefs to showcase their experience, signature dishes and availability, and allows Venues to browse and directly contact chefs whose profiles are publicly listed on the Platform.

ChefLink Sydney is not a recruitment agency, labour-hire provider, or employer. We do not employ, supply, roster, insure, pay wages to, or supervise the work of any Chef. We do not vet, verify, background-check or guarantee the accuracy of any Chef's qualifications, experience or conduct beyond the information the Chef has chosen to submit. Any engagement, work arrangement, rate of pay, roster, agreement or contract between a Chef and a Venue is entered into directly and solely between those two parties. ChefLink Sydney is not a party to, and accepts no responsibility or liability for, any such arrangement, its performance, or any dispute arising from it.

3. Eligibility

To use the Platform you must be at least 18 years of age and capable of forming a legally binding contract. By submitting a Chef Profile you confirm that all information provided is true, accurate, current and not misleading, and that you are the person the Profile represents (or are authorised to act on that person's behalf).

4. Chef Profiles — Content, Ownership & Licence

4.1 You retain ownership of all Content you submit. By submitting Content, you grant ChefLink Sydney a non-exclusive, royalty-free, worldwide licence to reproduce, display and publish that Content on your public Profile, and on directory, homepage, featured, graduate-spotlight or other promotional placements within the Platform, for the purpose of presenting your Profile to Venues.

4.2 You warrant that you own, or have obtained all necessary rights and permissions to use, any photograph, image or other material you upload, and that your Content does not infringe the intellectual property, privacy or other rights of any third party.

4.3 New and edited Profiles may be reviewed before appearing in the public directory. We may decline to publish, edit for formatting or presentation, suspend, or remove any Profile at our discretion, including where Content is inaccurate, inappropriate, infringing, or where a Subscription has lapsed.

4.4 You may request correction or removal of your Profile and Content at any time by contacting us (see clause 14).

5. How We Use Your Information (Chef Data)

This clause reflects how information you provide as a Chef is used, and is central to our commitment to you.

5.1 Information you submit is used only for the following purposes: (a) to display on your public Profile in the form you have provided and approved; and (b) internally by us, to administer your account, respond to your enquiries, and contact you regarding your Subscription — including trial reminders, payment or renewal notices, service updates, and occasional promotional messages about ChefLink Sydney itself.

5.2 We do not sell, rent, trade or otherwise disclose your personal information to third parties for their own marketing purposes. We do not share your information with any party outside the Platform except: where you have made it public via your Profile; where required to process a payment (e.g. our payment processor); where required by law; or where necessary to enforce these Terms.

5.3 When a Venue contacts you through the Platform (for example via a "Send Inquiry" form), any details they submit are used to facilitate that introduction. Once contact is made, subsequent communication and any resulting arrangement occurs directly between you and the Venue, outside the Platform, and is not monitored, stored or controlled by us.

5.4 We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). If you wish to access, correct or request deletion of your personal information, contact us using the details in clause 14.

6. Fees, Subscriptions & Payment

6.1 Certain Profile features and visibility levels are offered on paid Subscription plans, which may include an initial free trial period, details of which are displayed on the Platform at the time of signup.

6.2 Fees are charged in Australian Dollars (AUD) and processed via our third-party payment provider (PayPal). We do not store your full payment card or account details.

6.3 Except as required by the Australian Consumer Law, fees already paid are non-refundable. Where our Service fails to meet a consumer guarantee that cannot be excluded under the Australian Consumer Law, you may be entitled to a refund, replacement or other remedy.

6.4 We may change Subscription pricing or features on reasonable notice. Continued use of a paid Subscription after a price change takes effect constitutes acceptance of the new pricing from your next billing/renewal.

6.5 We may suspend or downgrade a Profile where payment is not received or a trial period has expired without payment.

7. Venue / Restaurant Users

7.1 Venues may browse the public directory and contact Chefs directly using the tools provided on the Platform. By submitting an enquiry, you consent to that information being used to facilitate an introduction to a Chef.

7.2 You are solely responsible for verifying a Chef's suitability, qualifications, right to work, insurance and any other requirement relevant to your engagement of them, and for the terms of any resulting arrangement.

8. Acceptable Use

You must not: use the Platform for any unlawful purpose; submit false, misleading, defamatory, offensive or infringing Content; attempt to scrape, copy or republish Platform data in bulk; interfere with the security or operation of the Platform; or impersonate another person or business.

9. Third-Party Services & Embedded Content

The Platform may display or link to third-party services (including but not limited to Instagram, PayPal, and embedded presentation or chatbot tools). We are not responsible for the content, availability, security or privacy practices of third-party services, which are governed by their own terms.

10. Intellectual Property

Excluding Chef-submitted Content (see clause 4), all design, code, branding, layout and platform features of ChefLink Sydney are owned by us or our licensors and may not be copied, reproduced or reused without permission.

11. Disclaimer & Limitation of Liability

11.1 The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, express or implied, regarding the accuracy, completeness, reliability or availability of the Platform or any Chef's Content.

11.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

11.3 To the maximum extent permitted by law, our total liability arising out of or in connection with the Platform is limited, at our option, to re-supplying the Service or refunding the fees paid by you for the Subscription giving rise to the claim in the preceding 12 months. We are not liable for any indirect, special or consequential loss, or for any loss arising from arrangements made directly between a Chef and a Venue.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, loss, damage or expense (including legal costs) arising from your breach of these Terms, your Content, or your use of the Platform.

13. Suspension & Termination

We may suspend or terminate your access to the Platform, or remove a Profile, at any time, with or without notice, where we reasonably believe these Terms have been breached, fees are unpaid, or Content is inappropriate or unlawful. You may close your account or request removal of your Profile at any time by contacting us.

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
